The Federal High Court in Lagos has appointed an interim receiver over a Victoria Island property linked to Maryam Abacha amid a dispute with Levitikal Realties & Construction. The order prevents the company from dealing with the property pending further proceedings, but does not determine ownership or the parties’ final rights.

The Federal High Court in Lagos has placed a Victoria Island property linked to Maryam Abacha under interim receivership while a dispute over its development is considered. Justice Ambrose Lewis-Allagoa issued the order on 29 September, appointing the court’s deputy chief registrar or an official receiver to take possession and control of the property at 68 Molade Okoya Thomas Street, off Ajose Adeogun Street. The order bars Levitikal Realties & Construction, its directors, agents and others acting for the company from selling, transferring, assigning, mortgaging, leasing, charging or otherwise dealing with the property.

The case was brought by Abacha in suit FHC/LAG/CS/1245/2026. According to an affidavit filed by her son, Sadiq Mohammed Abacha, Maryam Abacha is the registered owner under a Certificate of Occupancy dated 4 July 1988. She entered a 2021 joint-venture agreement with Levitikal to redevelop the site into 18 three-bedroom flats, with nine completed flats intended for the developer.

The affidavit alleges that the agreement and a later power of attorney did not transfer ownership of the land. It further claims that Levitikal failed to obtain statutory building approval and complete the project on time. Abacha subsequently revoked the power of attorney and terminated the agreement in May, according to the filing.

The affidavit also alleges that Levitikal used the property as collateral for credit facilities from Providus Bank and continued marketing it after the agreement was terminated. Those claims have not been determined by the court. The judge authorised the appointment of a qualified property-management firm and directed police, the EFCC and other agencies to assist with enforcement.

Abacha was also permitted to publish the order to notify potential purchasers, lenders and investors. The order is temporary and does not finally decide ownership or the substantive rights of either party. The case was adjourned until 9 November.
